§ 1 Scope
These general terms and conditions (hereinafter referred to as “GTC”) apply to all deliveries by Gert Weißbach GmbH to consumers (§ 13 BGB). We hereby expressly oppose any differing rules of the contractor.
A consumer (hereinafter referred to as “customer”) is any natural person who concludes a legal transaction for a purpose that can be attributed neither to their commercial nor their self-employed professional activity.

§ 3 Offer and conclusion of contract
(1) The presentation of the products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. Errors excepted. The customer can select products from the Weißbach Sports / Gert Weißbach GmbH range and collect them in a so-called shopping basket by clicking the “Add to basket” button.
(2) By clicking the “Order with obligation to pay” button in the last step of the ordering process, you place a binding order for the goods listed on the order page. The purchase contract is concluded when we accept your order by sending an order confirmation via e-mail immediately after receiving your order.
§ 4 Return costs
If you make use of your statutory right of cancellation (see cancellation), you have to bear the regular costs of the return if the delivered goods correspond to the ordered ones.
Returned goods not prepaid or returned by cash on delivery are generally not accepted. If you want to return something, please contact us beforehand.
§ 5 Shipping costs
(1) The prices stated on the product pages include statutory VAT and other price components.
(2) Information on additional shipping costs can be found in the shipping costs overview.
§ 6 Delivery
(1) Deliveries within Germany are made with our logistics partners DPD and EMONS.
(2) The delivery time depends on the destination country. You can find all prices in our shipping costs overview.
§ 7 Payment
(1) Payment can be made either in advance/bank transfer, Paypal or payment via EC upon collection.
(2) Payment for CUSTOM SKIBIKES is made exclusively via Paypal. Prerequisite for the start of production is the receipt of money for the entire invoice amount, in addition, a CUSTOM SKIBIKE must be expected with a longer waiting time for the production, which is between 4-6 weeks. Shipping times are not included in the 4-6 weeks.
(3) You only have the right to offset if your counterclaims have been legally established by a court or are undisputed or have been recognized by us in writing.
(4) You can only exercise a right of retention if the claims result from the same contractual relationship.
(5) If payment is not made within 14 days of placing an order, we reserve the right to cancel the order.
§ 8 Reservation of ownership
Until full payment the goods remain our property.
§ 9 Contract text
The contract text is stored on our internal systems. You can view the terms and conditions at any time on this page. If you have created a customer account, you can view and edit your customer data at any time under “MY ACCOUNT“. The order data and the terms and conditions will be sent to you by e-mail. After completion of the order, the contract text is no longer accessible via the Internet for security reasons.
§ 10 Warranty and guarantee
Based on the legal basis, the warranty for customers as consumers is 2 years from delivery of the goods. We grant the same to commercial customers. Gert Weißbach GmbH grants 5 years warranty on frame and swingarm. Not included in the warranty are wear parts such as ball or plastic bearings as well as paint, anodized coating and ski.
Warranty and guarantee claims expire if the skibike shows signs of wear or damage which can be traced back to improper use or use not in accordance with the intended purpose.
The following points are to be classified to this:
- Overstraining of any kind due to falls or jumps
- The installation of non-approved chassis components
- Lack of maintenance and care
- Operation after defects have been detected / defective spring elements or worn-out bearings
The warranty claim applies exclusively to first-time buyers of our product and requires the original invoice as well as the serial and customer number. In your assembly instructions on page 1 these data are additionally stored.
We reserve the right to charge the customer for separate services such as assembly and transport.
§ 11 Liability
Gert Weißbach GmbH is not liable for damages or injuries to life, body, or health, which result from negligent or improper handling of our products.
